Servicio de Escrow
Brindamos a nuestros clientes la opción de ser fiduciaria en sus Contratos de Fideicomiso, el cual consiste en un acuerdo de voluntad entre las partes contratantes por medio del cual una persona física o jurídica denominada Fideicomitente, traspasa a otro que es llamado fiduciario, bienes o derechos, para que los administre y les de los fines propuestos en el contrato, para beneficio de una tercera persona denominada Fideicomisario o Beneficiario. Tenemos como propósito fundamental llevar a cabo una eficiente y comprometida labor en materia fiduciaria, satisfaciendo sus necesidades de manera competitiva y confiable. Nuestro mercado meta son personas físicas y jurídicas de todo el mercado costarricense, tanto privado como público.
El Servicio de Escrow es un contrato mediante el cual un activo (a menudo dinero) es entregado a un tercero llamado Agente de Escrow, con el fin de llevar a cabo una transacción relacionada con bienes raíces.
Dicho dinero será mantenido en una cuenta de Escrow siendo necesario para su desembolso el cumplimiento de una condición o varias condiciones ya establecidas en un contrato de compraventa previamente pactado por el comprador y vendedor. Verificada la realización de aquel acontecimiento, el Agente de Escrow comunicará el hecho al comprador y entregará el activo al correspondiente beneficiario.
El Agente de Escrow es un tercero imparcial, por lo que en virtud de su mandato si dicha condición no se cumpliese, deberá mantener el dinero en la cuenta de Escrow. Como remuneración de su labor, el Agente de Escrow recibe el pago de una comisión ya pactada con las partes.

TARANOVA BRANCHES TRUST & ESCROW SERVICE provides a means of security in the handling of important property, funds, and documents. We, as an escrow holder, work with the Buyers, Sellers, Lenders and Borrowers (“the principals”) involved in a transaction to assure funds and documents change hands at the appropriate point in time, after preset conditions have been met. TARANOVA BRANCHES has been approved and is authorized by the Costa Rican Bank Superintendence to provide escrow services.
An Escrow stipulates the contractual provisions between transacting parties, whereby the independent trusted third party (Escrow Agent- TARANOVA BRANCHES) receives and disburses money or documents for the transacting parties. The timing of such disbursement by the third party is dependent on the fulfillment of contractually agreed conditions by the transacting parties.
If conditions of the escrow contract cannot be met, the funds held will not be disbursed and can be given back to the investing party. If there is a disagreement as to whether contract conditions have been fulfilled, an arbitration service must judge the contract according to the contract to determine whom the funds belong to.
A Trust, is an agreement among contracting parties, where a person or legal entity called Trustor, transfers to the trustee, assets or rights to be managed in benefit of the beneficiary. In order to understand the nature of trusts in a general sense, a trust is nothing more than an arrangement whereby one person agrees to hold property for the benefit of another. A fiduciary relationship encompasses the idea of faith and confidence. All of the fiduciary’s actions are performed for the advantage of the beneficiary.
